5. Orders and Payment
5.1 Order Acceptance
Your order constitutes an offer to purchase products. We reserve the right to accept or reject any order for any reason. Acceptance of your order occurs when we ship the products or send you an order confirmation email, whichever occurs first.
5.2 Payment Methods
We accept major credit cards, debit cards, and other payment methods as indicated on our website. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us to charge the full amount of your order.
5.3 Payment Processing
Payment is processed at the time of order placement. If payment cannot be processed, we will notify you and may cancel your order. You are responsible for any fees charged by your financial institution.
5.4 Pricing Errors
Despite our efforts to ensure accuracy, pricing errors may occur. If we discover a pricing error after you have placed an order, we will notify you and give you the option to confirm the order at the correct price or cancel the order for a full refund.
6. Shipping and Delivery
6.1 Shipping Policy
We ship to addresses within Canada only. Shipping costs, delivery timeframes, and policies are detailed in our separate Shipping Policy. By placing an order, you agree to the terms of our Shipping Policy.
6.2 Delivery Requirements
Tobacco products require adult signature upon delivery. You or an adult (of legal smoking age) must be present to receive the shipment and provide valid government-issued photo identification. If no one is available to sign for the delivery, the package will be returned to the carrier for redelivery or pickup.
6.3 Risk of Loss
Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for lost, stolen, or damaged packages after they have been delivered to the carrier.
7. Returns and Refunds
Our return and refund policies are detailed in our separate Return Policy. By making a purchase, you agree to the terms of our Return Policy. Due to health and safety regulations, tobacco products may have limited return eligibility.
8. Health Warnings and Disclaimers
8.1 Health Risks
WARNING: Tobacco use is addictive and causes serious health problems including cancer, heart disease, stroke, lung disease, and other conditions. Tobacco smoke contains over 7,000 chemicals, including hundreds that are toxic and about 70 that can cause cancer.
8.2 No Medical Claims
We make no health claims about our products. Our products are not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare professional if you have questions about tobacco use and your health.
8.3 Cessation Resources
If you wish to quit smoking, we encourage you to seek help. Resources are available through Health Canada's Quit Smoking Resources.
9. Prohibited Uses
You agree not to use our website or services for any unlawful purpose or in any way that violates these Terms. Prohibited uses include but are not limited to:
- Purchasing products for resale without authorization
- Providing false information during registration or purchase
- Attempting to circumvent age verification measures
- Using automated systems (bots, scrapers) to access our website
- Interfering with the proper functioning of our website
- Attempting to gain unauthorized access to our systems
- Purchasing products on behalf of minors
- Violating any applicable laws or regulations
11. Limitation of Liability
11.1 Disclaimer of Warranties

Our total liability to you for any claims arising from or related to these Terms or your use of our services shall not exceed the amount you paid to us in the six (6) months preceding the event giving rise to liability.
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
14.2 Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for the resolution of any disputes arising from or relating to these Terms or your use of our services.
14.3 Informal Resolution
Before filing a legal claim, you agree to first contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith through negotiation.
14.4 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.
